Action Alert # 53 - We Have a New House Bill!– HR 1795 1

We are VERY happy to announce that a bipartisan bill (HR 1795) was introduced in the House last Friday, April 26, to repeal the Government Pension Offset and the Windfall Elimination Provision. It was introduced by Representatives Rodney Davis (R-IL) and Adam Schiff (D-CA).  WE THANK THEM!  The text of the bill should appear on www.thomas.loc.gov in a few days. You can always check that site to read the bill (search for the bill by number) and to see if your Congressperson has signed on as a co-sponsor. We are expecting a similar bill to be introduced in the Senate very soon.

Urge your Representative to support and co-sponsor the bill to end GPO and WEP, and restore Social Security fairness! This is easy!  Go to www.house.gov, find their website and bookmark it. Take a few minutes to call or email them and let them know you are expecting their support. Repeat this process every month.

We need remind them constantly of this problem.

  1. Having worked and PAID all my social security dues, in both the UK and the US, I now find out that the American Government will deduct the sum of $486.00 from my social security. Had I worked for the US my whole working life, I would have had a pension in excess of $2000.00 per month. Now I am almost 69 years old and have not collected my US social security as I am still working full time, still paying into the social security fund with no hope of reaping any benefit, I paid from my hard earned paycheck every week in the UK, social security dues, then here in the US I PAID social security dues again with the expectation that I would receive what was due to me at retirement, I find myself unable to retire because of the money being STOLEN from me. No-one in congress contributed to my pensions in either country, so why are they taking it from me. It is actually illegal what you are doing, and I urge you to look into all of the discriminatory aspects of this horrible practice. I also PAID TAXES to BOTH countries while I was working. I urge you to look up the meaning of the word “WINDFALL” in the dictionary, because I would in no way shape or form call my hard earned money a windfall, Is this so that Government INFLATED pensions can keep getting bigger, and people like myself and thousands of others LOSE their pensions that they HAVE WORKED ALL THEIR LIVES FOR. —–SHOCKING

    1. I also worked in U.K. before emigrating to USA in 1984. I started taking Social Security at age 66 last year. But they applied WEP and reduced my Social Security benefits by about $350. I appealed and I will get a hearing in August 2014.

  2. This changing of the Bill number has been done before. BUT it still never solved the problem………….will [t ever? or is this another way to soothe the tired teacher. I have been retired since 96………..they said than we would win. Than, Obama said it would be the first thing he would do. I understand that there was a time all it needed wasfor the president.to sign. How did Texas a nd 10 other states get around it. They are receiving something. I must say I am discouraged. I am afraid it will pass way after my demise. Sorry if I am not excited about this last deal. I’ve danced this dance too many times and my feet are a mess from all of the politicians stepping on my toes.

    1. We live in Texas and my wife just got surprised with a $480 reduction of SSA spousal benefits as well as a bill for $3680 for over-payments. We’re NOT HAPPY..!

  3. I hope its not the “same song, different band” again. My husband paid SS for 55 years and received ONE (1) check before he died. I cannot get his SS because of my teachers pension. There have been several similar bills, but none have passed. I will continue to support ANY efforts and hope that someday, some how repeal sneaks through. Maybe I can have some extra’s in my old age.

    1. Dear Nancy. I too am a widow and am not able to receive my deceased husbands SS because of my teacher pension. To add to the wound, i have SS of my own that I am unable to receive due to the unfair law that is hurting thousands of educators. I pray that HR 1795 will repeal what has been done to us. All we want is what LEGALLY belongs to us. What the government is doing is illegal and should be considered theft.

I wish more people would leave comments of support & say that they have contacted their Congressional Representatives as well as the friends and relatives to help us on our very difficult quest for fairness. CONTACT YOUR CONGRESS PEOPLE FOR SUPPORT…or don’t complain when this is dead in commitee!!!!

  5. Shame on our Congressional & Senatorial Representatives. You should stand by all public working citizens and fight to get WEP and GPO repealed. It is not only unfair to so many hard working citizens who devoted the working years in support our many public institutions, but also a crime. To allow those who have never gone out in the public workplace yet received their spouse’s social security benefits without even contributing a penny to Social Security. It is an OUTRAGE! We are asking only fairness and equality across the board to all US citizens.

    Our spouses benefits and/or our hard earned benefits we paid into the SS systems must be remedied! Stand up for SS Fairness! You owe it to your constituants!

  7. After working for more than 30 years under social security and 10 years as a teacher , I am now threatened with losing half my teachers benefit because of WEP. Even though I had surpluses of taxable income that surpassed the yearly “substantial” income that is necessary for an exemption from WEP, I will still be penalized. It strains the imagination to comprehend how unspeakably unfair this law is.

  8. I have been working since I was ten years old. For almost fifty years I have contributed to Social Security.
    I have been penalized to receive my full retitrement benefits under Social Security, because I receive a pension from the Commonwealth Of Massachusetts. This is an outrage.I have worked two jobs for thirty -five years. Now in my retirement years I loose approximately sixty percent of my Socilal Security benefits.Other individuals in the private sector with private pensions are unaffected. Pasage of U.S. House Bill Fairness Act is essential. BY enlarge public employees and retirees are not a wealthy segment of the of the population.Please urge all you representative, senators to pass U. S. Hose Bill 1795.

  9. June 10, 2013. I had nearly given up on repealing the GPO and WEP but hopefully the new bills which have been introduced in both the House and Senate. When we planned our retirement income, there was no penalty because I had gone to work as a teacher. I was still entitled to my share of my husband’s S. S. and then shortly after he passed on, both the GPO and WEP Bills changed all that. We had been very careful in planning both our retirements, bur despite all our efforts for repeal, the finance committees in both the Senate and the House, refused to let either bill come to a vote. I try to live very frugally, but there is no way I can earn more money to maintain housing, medical expenses and transportation costs. When I read about the privileges most Congressmen have, it just doesn’t seem fair. I just don’t think we need as much government as you are providing us. There are so many ways you can control governmental spending: limiting the length of campaigning, limiting political trips and travel expenses. At least, let the committees vote on the Repeal Bills.   10. I have requested before that the WEP and Social Security Fairness Act be addressed. Now I find that my social security benefits have been cut in half. I was told that it was because of the cost of living raise for 2013. At this rate when the next cost of living raise comes I will not receive any benefits. Initially I wasn’t even receiving my full entitlement because of the WEP. Now this! I was told by the Social Security office in my area not to bother to appeal because it would only be denied. I am retired as are so many other people and we urge you to please address this problem. With lowered income and higher taxes, we are pretty much behind the eight ball. Thank you.

  11. I have paid into SS since I was a teenager in High School, then started working in State Government in 2001, paying into OPERS (Ohio). I think it is only fair that I get back what money I paid in, instead of giving it to an illegal immigrant, of which the Obama Administration seems wanton to do.

  12. We are in favbor of 1795. This was a bad deal in the first place. Social Security is used for SSI,
    illegal immigrants, people seeking political asylum, etc. What about the retired tax paying Americans?

  13. It’s not fair to have my Social Security benefits reduced by almost 57%. I accumulated at least 40 credits of coverage while I worked in the private sector. I retired from the US Government at the age of 57 with 30 years of service. . When I was 62, I was supposed to receive a monthly estimate of $595.00 of S.S. Benefits and instead, I am receiving $252.00 due to the GPO Act and the WEP. There are other US Gov. Retirees who do not receive a decent pension and this two provisions are killing them. Please, make justice and repeal the GPO and WEP.

This bill should not effect those who paid into a pension prior to this bill passing.We should have been grandfathered in, I wasn’t allowed to pay into SS while working and paying into my state retirement system.i would have had to quit this job so I would not be penalized. Please fix this problem it’s wrong!!!

I received my SS card in 1958 and started work at 14 , when I had my 18th birthday I joined the Army reserve and worked at the same time as Mechanic in a dealership ,paying my SS taxes at both jobs . in 1969 I went to work as a dual status National Guard Tech. as a accepted employee of the Army and required to be in uniform and perform as a member of the Military.
    I continued to pay my SS taxes on my military pay. I retired from the Tech job in 2001 with 32 years and went to work for a Hardware store. with over 55 years paying my SS tax. I retired from the National Guard at age 60 in 2004. I had put in over 41 years in service to my country

  16. I in 2001 at age 56 I retired as a Dual status Army National Guard Tech, with 32 years Tech service , I paid into the SS for over 55 years through my civilian jobs and the military. I had to retired from the Military side 2004 at the mandatory age 60. Now I receive about 285 dollars a month after taxes and Medicare from SS because of WEP.

    my body is worn out and I lost hearing in one ear . I was proud of my service and hated to leave .but I never thought my country would cut my Social Security . I paid from 14 years old until 62 when I became disabled I went on SS.

  20. Because of WEP I receive $150 per month for Social Security.I retired in 2006 and was a teacher for thirty-three years.I taught eight hundred children how to read. I contributed to to the betterment of my country . I had paid into S.S. the first thirteen years of my career.After getting divorced I taught in a catholic school for five years in Santa Monica, CA. I was earning $780 a month and my rent was $400 each month.I lived like this for five years. My cousin convinced me to move to Texas, so my parents bought me a ticket to fly to Aldine,Texas to seek employment. I was interviewed and accepted an elementary position. During the interview I was NEVER told that Aldine did not pay into S.S. They did give me credit for my thirteen years of experience. This is unusual because when a teacher seeks a new position she looses her seniority.Most school districts will pay an experienced teacher at a third year level. Amazing! When I received my first paycheck I noticed that money was not taken out for S.S. I was very upset since I was a single mother and had always planned to have S.S. for my retirement. I was informed that I would receive $598 monthly when I retired.I adjusted to the bad news and planned my retirement around that amount.Can you imagine the shock that I received when I went to the S.S.office for information on retirement?I was told aia would receive $150. To get around WEP teachers that were married more that ten years were allowed to work for one day and retire from a district that paid into S.S.They would then be allowed to receive half of their husband’s S.S. I was only married eight years so I did not quality.I wanted my own.In order to have enough money to live, I was forced to buy back six years. I had withdraw the money foolishly. Two thousand eight hundred dollars grew to $36,000 compounded interest.Buying the years gave me a teacher retirement of almost $3,000 per month.I could no live on $2200 per month.The WEP reduced my S.S. from $598 to $150 each month.I have been upset since 2005 because of this injustice that was done to me.To add insult to injury I have a friend who never worked a day in her life. She receives $900 monthly because her husband was a CEO.My other teacher friend receives full S.S. She was not forced to buy her years back.Being a single woman WEP is most unfair.I am an educated person who dedicated her life to helping children. And this is how my government repays me!!!

The Federal Unemployment Extension would save her house as well as save my house and my retirement, but no one is acting on this issue.   23. I am 80 years old. I have been working since I was 16 years old so I have well over 40 quarters paid into SS. I also worked under RR retirement for 10 years and paid into SS and RR retirement and receive $78 from RR on my widow’s pension. I am now working for the City of San Diego and will retire in 4 years, but my widow’s pension will be reduced by 2/3 because of GPO/WEP. This is not fair. We paid into both plans but are being penalized. We are told not to depend just on SS for our retirement, so we take other jobs so we can get another pension and not have to rely on the government when we do retire. I thought we all paid into the same SS system and were under the same government. Why are some states allowed to keep their benefits and we have to give back 2/3? Does any of that make any sense to anyone. If our representatives had to abide by these laws, they would be changed in a hurry. These laws need to be repealed. I sure hope so.

  24. About 25 year ago I went to a one day retirement seminar at HUD and asked if I am grandfathered

    eegarding the WEP because i had the required combined military and HUD 30 years which made me

    eligible to retire at 55. I was 57 at the time of the 1983 legislation. But I did not know what the actual

    implementation date might be. I was born february 9, 1929. i retired with 20 years in the NAVY IN SEP

    1969 and went to work for HUD Dec 15, 1969 now have almost 44 1/2 years at HUD.

    At the one day seminar i asked about grandfathering. The person checked with Social security and said

    YES. However, every other seminar i attended had no answers whatsoever… Ssocial Security didn’t

    answer and the person conducting the seminar did no follow up at all..

  25. It is truly UNFAIR to have any Social Security Benefit reduced by almost 55%. I accumulated over 40 credits of coverage with the military, after serving my country on a Peace Keeping Mission of Beirut, Lebanon and all over the world, I eventually left the US Government at an early age of 57. When I became 62, I was supposed to get $1,400.00 of SS benefit and instead received $641.00 due to the Government Pension OFFSET and Windfall Elimination Provision. These two provisions are killing your Americans who worked all their lives with the Military and Government, to be KICKED in the Face of Injustice and I am begging that the GPO and WEP be repealed

I receive a small pension , teacher raised two children last fifteen years, get less than 1/3 of SS, paid for 19 years, ex husband 45 years, I get 0 from him, I am at poverty level, have to sell my home , this is just another example, of how American citizens seniors are not appreciated, and we can give aid to countries, spend billions on military support , disaster funds, and then deprive our own American citizens.

  28. I’m a retired Detroit Police Officer and a Vietnam vet. Detroit recently went through a bankruptcy costing retirees thousands of dollars. I lost my health care, dental and optical for my mife and myself. If this offest is passed and I receive what I should be getting, it will help to pay for these losses. I find it highly unfair that I risked my neck in Vietnam only to be stabbed in the back by the same government that sent me there. I earned my social security, it wasn’t given to me. I hope these politicians in DC do the right thing and make us whole.

  29. There was an article in the Union Tribune in San Diego. It said the SS system paid 20.2 million dollars to Nazi citizens. That money would have gone a long way for retired government workers and teachers. Isn’t America great!!! It makes me so angry when I read about how some people are cheated out of the money their spouses paid into SS and because they get a government or teachers pension, it’s taken away from them. They earned it and are entitled to it. Some people are against this, but we’re not asking for more than we deserve. Nothing more or less. Let’s be fair I’m 81 and still working because I don’t want to give SS any of my earned SS benefits. Let’s get off our a__ and do something about this unfair practice. Can’t our representatives see how unfair this is? Believe me, if they had to go by the same rules it would be repealed in a hurry. God Bless America.

    1. That bill was introduced 2 years ago ! No action has been taken on it in Congress till date (June 2015.)
      Why ? The Republican Congress will not take it up as it will increase Social Security payments. So for all practical purposes H.R. 1795 is dead! I contacted my Representative Rush Holt in New Jersey last year about my reduction of Social Security benefits with the unfair application of WEP but he did nothing and told me to contact my Senator instead!

  30. I was told that my husband passed away before me that I could get 100% of his, but they would take two thirds of it away so I would get less then I get of my own.
    I bet if the Congress had to live on what we get they would have fixed it when it started. They make $174,000 a year with all expenses paid, and think that we can live on $1,600.00 a month
